What is an Activities of Daily Living Assessment?

Topic

At some time in your motor vehicle accident claim, the CTP insurer may raise the prospect of an Activities of Daily Living, or ADL, assessment being conducted, or it may be suggested by your legal representative.

This blog will explain:

  • What an ADL assessment is;
  • What  the value of an ADL assessment is;
  • When an ADL assessment be conducted; and
  • Who can perform an ADL assessment.

An ADL assessment is typically performed by a qualified Occupational Therapist or Physiotherapist. It assesses an injured person’s ability to perform their activities of daily living, i.e. their personal care tasks and their domestic and garden duties to upkeep and maintain their living environment. The assessment report from an ADL assessment also commonly provides the assessors recommendations as to services or aids to assist the injured person in having their activities of daily living needs satisfied.

An ADL assessment could be performed after the injured person’s injuries have reached maximum medical improvement. This is for the purpose of:

  • assessing the injured person’s capacity to perform their activities of daily living;  determining the type of services and aids that are recommended for the injured person;
  • estimating the cost of those services and aids; and
  • assistance at a settlement conference or to the Court in quantifying a claim for compensation.

Alternatively, the ADL assessment could be performed while the injured person is recovering from their injuries, to determine their capacity and obtain recommendations for assisting the injured person in the short term, until the claim is resolved.

As an ADL assessment typically involves an interview of the injured person by the assessor at the injured person’s home, it is important to speak to a lawyer prior to the assessment being conducted.  If the CTP insurer has arranged an ADL assessment, or you are struggling with your activities of daily living following a motor vehicle accident, please contact MKF Lawyers to discuss your motor vehicle accident claim on a confidential basis.
